Laws & Rules for Cosmetology
Authorizing Statutes & Rules

Regulations governing cosmetology (barbering, esthetics, hair design and nail technology) in Oregon are contained in Oregon Revised Statutes (ORS) 690.005-690.235 and 690.992 and Oregon Administrative Rules (OAR) Chapter 817, Divisions 005-120.
 
Oregon Health Licensing Agency (OHLA) statutes and rules governing administrative, procedural, licensing and regulatory compliance requirements for all OHLA-regulated professions are found in ORS 676.605-676.625 and 676.992 and OAR 331, Divisions 001-030.

Current Rulemaking
Public Comment
The Board of Cosmetology is in the first phase of administrative rulemaking.  Often during this time public comment is not taken in an effort to prepare for the second phase of administrative rulemaking.
 
Once the board approves proposed Oregon Administrative Rules (OARs), the rules are filed with the Secretary of State. The proposed date for filing proposed rules is July 1, 2010, at which time the public comment period begins.  During this time written comments will be accepted.
 
The public comment period will close as of July 30, 2010, giving interested parties 30 days to comment.  On July 30, 2010, the Oregon Health Licensing Agency and board will hold a public hearing where oral testimony will be received by a contracted hearings officer.
 
The board will review and consider all comments and recommendations at the full board meeting on August 27, 2010 (conference call), to adopt fees and November 8, 2010, regarding all other rulemaking.

Public Attendance Versus Participation
Is the public or licensees allowed to attend the Rules Advisory Committee Meetings?
 
Yes. Members of the public are invited and encouraged to be in attendance at all board committee meetings. However, this does not mean the committee will allow for participation from audience members under Attorney General's Meeting Manual ORS 192.630.
 
Committee members may opt to call on subject matter experts (SME) for knowledge in specific areas.  Decisions to call on SMEs will be made by the board members at the time of the meeting.

Fee Change Delay Continued 
OHLA originally delayed the fee changes to allow the agency to report on the proposed changes to the Interim Joint Committee on Ways and Means of the Oregon State Legislature in January 2010. 
 
Further consideration by OHLA, the Department of Administrative Services and the Board of Cosmetology of the fees and the cost allocation showed that continued review and foresight of the overall agency budget and the Board of Cosmetology budget was necessary before decreasing the cost to new applicants and increasing the cost to business owners. 
 
It was determined that an extensive review of all costs and fees including all OHLA programs and renewal cycles would be done before fees could be further changed. 
 
The fee review is scheduled to begin April, 2010.  See the rulemaking schedule linked below.
